Marketplace Guest Terms of Use

Note (2026-07-28): these Guest Terms are dormant — the consumer Marketplace is not yet open to the public — and take effect for a Guest only when the Marketplace launches and the Guest uses it.
These Marketplace Guest Terms of Use (the "Guest Terms") form a legal agreement between you ("you", "your", or "Guest") and PeasyBooking Technologies Inc., a corporation incorporated under the Canada Business Corporations Act (Corporation No. 1804322-1), with registered office at 150 Evergreen Mount SW, Calgary, Alberta T2Y 0L8, operating as "PeasyBooking" ("PeasyBooking", "we", "us", or "our").
These Guest Terms govern your use of the PeasyBooking consumer marketplace, including our websites, web applications, and any related features through which members of the public can discover service providers, book appointments, pay for services, leave reviews, and cancel bookings (together, the "Marketplace").
These Guest Terms apply only to Guests using the Marketplace. They do not govern the businesses that use PeasyBooking's practice-management software, whose use is governed by the PeasyBooking Business SaaS Terms and, where applicable, the Provider Marketplace Agreement.
PLEASE READ THESE GUEST TERMS CAREFULLY. They contain important limitations on our responsibilities, an emergency disclaimer, a statement that we do not verify Provider credentials, and a description of how disputes between you and a Provider are handled. By accessing or using the Marketplace, by creating a Guest account, or by booking an appointment, you agree to these Guest Terms. If you do not agree, do not use the Marketplace.

1. About PeasyBooking and the Marketplace
1.1 PeasyBooking is a platform, not a service provider. The Marketplace is a technology platform that connects you with independent third-party businesses and practitioners (each, a "Provider") who offer appointment-based services such as facials, physiotherapy, haircuts, massage, and other personal-care, wellness, and related services (each, a "Service"). PeasyBooking lets you find Providers, request and pay for appointments, communicate, and leave reviews.
1.2 PeasyBooking is not a party to the service relationship. Each Service is provided by the Provider, not by PeasyBooking. When you book an appointment, the agreement to provide and receive that Service is between you and the Provider. PeasyBooking is not the provider of the Service, is not your healthcare provider or care practitioner, is not a party to your contract with the Provider, and does not supervise, direct, or control the Provider or the Service.
1.3 No agency or endorsement. Providers are independent businesses. PeasyBooking does not employ Providers, does not act as their agent or representative, and does not guarantee, warrant, or endorse any Provider, Service, or Provider listing. Listings, descriptions, qualifications, and availability are supplied by Providers. PeasyBooking provides payment technology that enables a Provider to collect payment through the Provider's own Stripe account (see Section 7); PeasyBooking is not the Provider's agent for collecting funds, never takes custody of Service funds, and is not the merchant of record.
1.4 We do not verify Provider credentials. PeasyBooking does not independently verify any Provider's licences, registrations, certifications, insurance, qualifications, scope of practice, or professional standing, and does not confirm that a Provider is licensed, insured, or in good standing with any regulator or professional college. Listing on the Marketplace is not a credential check, a background check, or an endorsement. Before booking or receiving a Service — particularly a regulated health service such as physiotherapy or massage — you should confirm a Provider's credentials directly with the Provider and, where applicable, with the relevant professional college or regulator. See also Section 2.
1.5 City-by-city availability. The Marketplace is rolled out in selected cities and expands as Provider supply grows. Availability of Providers, Services, and features varies by location and over time, and may change or be withdrawn without notice.

2. Eligibility
2.1 Age and capacity. To use the Marketplace, create a Guest account, or book an appointment, you must be the age of majority in your province or territory of residence and have the legal capacity to enter into a binding contract. The consumer Marketplace is intended for adults. If you are under the age of majority, you may not use the Marketplace, and you must not provide personal information through it. By using the Marketplace, you represent and warrant that you meet these requirements.
2.2 Booking for others. If you book or pay on behalf of another person, you are responsible for that booking under these Guest Terms and represent that you are authorized to act on that person's behalf.

3. Provider Responsibility for Services
3.1 The Provider is solely responsible for the Service. As between you, the Provider, and PeasyBooking, the Provider is solely responsible for:
- (a) the quality, safety, suitability, and outcome of the Service, and the professional care and judgment applied;
- (b) holding and maintaining all licences, registrations, certifications, qualifications, and professional standing required by law and by any applicable regulatory body or professional college;
- (c) maintaining appropriate professional, liability, and other insurance;
- (d) the accuracy of its listing, including descriptions, qualifications, scope of practice, prices, taxes, hours, and availability;
- (e) honouring confirmed appointments and managing its own scheduling and availability;
- (f) setting and applying its own pricing, deposits, cancellation and no-show policies and fees, tips, memberships, and packages;
- (g) issuing refunds and handling chargebacks, complaints, and disputes relating to its Services;
- (h) charging, collecting, and remitting all applicable taxes (including GST/HST) on its Services; and
- (i) complying with all laws, professional rules, and standards of practice that apply to the Provider and the Service.
3.2 PeasyBooking does not verify and does not provide care or advice. As stated in Section 1.4, PeasyBooking does not verify Provider licences, insurance, or professional standing. PeasyBooking does not provide medical, health, physiotherapy, cosmetic, or other professional advice or care, and nothing on the Marketplace is a substitute for the independent professional judgment of a qualified, licensed practitioner. Any decision about whether a Service is appropriate for you is between you and the Provider.
3.3 Your own due diligence. You are responsible for evaluating whether a Provider and Service are right for you, for confirming the Provider's credentials and good standing (see Section 1.4), for disclosing relevant information to the Provider (such as allergies, medical conditions, or contraindications), and for following the Provider's pre- and post-Service instructions.

4. Emergency Disclaimer — Important
THE MARKETPLACE IS NOT FOR MEDICAL EMERGENCIES OR URGENT CARE.
If you are experiencing a medical emergency, urgent or serious symptoms, or a mental-health crisis, do not use the Marketplace. Call 911 (or your local emergency number) or go to your nearest emergency department immediately.
The Marketplace is for booking scheduled, non-urgent appointments only. PeasyBooking does not provide emergency services, urgent care, triage, monitoring, or any clinical service, and does not guarantee that a Provider will be available, will respond, or will see you within any particular time. Do not rely on the Marketplace, messaging, reminders, or any PeasyBooking feature for emergency or time-sensitive medical needs.

5. Bookings, Cancellations, No-Shows, Deposits, and Refunds
5.1 How a booking is formed. When you submit a booking request through the Marketplace, you are making an offer to receive the Service on the selected date and time, subject to the Provider's terms and any deposit or payment required. A booking is confirmed only when the Provider (or the Marketplace on the Provider's behalf, according to the Provider's settings) accepts and confirms it. Some appointment slots are confirmed automatically; others require Provider review. Availability shown is not a guarantee, and a slot may become unavailable before confirmation.
5.2 Provider acceptance and changes. A Provider may decline, reschedule, or cancel a booking, including due to availability, scheduling conflicts, or its own policies. PeasyBooking is not responsible for a Provider's decision to accept, decline, reschedule, or cancel.
5.3 Cancellation windows and no-shows. Each Provider sets its own cancellation window, no-show policy, and any related fees. By confirming a booking you agree to the Provider's policies as disclosed at the time of booking. If you cancel late or fail to attend, the Provider may charge a cancellation or no-show fee in accordance with its disclosed policy.
5.4 Deposits and prepayment. A Provider may require a deposit or prepayment to confirm a booking. Whether a deposit is refundable, and on what terms, is determined by the Provider's policy disclosed at booking.
5.5 Refunds. Refunds for Services, deposits, cancellation fees, memberships, and packages are determined and issued by the Provider in accordance with its policies and applicable law. PeasyBooking does not control, guarantee, or fund refunds, and does not hold the funds (see Section 7). Refund requests should be directed to the Provider. PeasyBooking may, at the Provider's instruction and through the payment processor, assist in transmitting a refund the Provider has authorized.
5.6 Chargebacks. If you initiate a chargeback or payment dispute with your card issuer, that dispute is between you, your card issuer, the payment processor, and the Provider (as merchant of record). PeasyBooking is not the merchant of record for Services and is not a party to such chargebacks, though we may provide booking records to the Provider or processor as permitted by law.

6. Disputes Between You and a Provider
6.1 Provider disputes are between you and the Provider. Because PeasyBooking is not a party to the Service, any dispute, claim, or concern about a Service — including quality, outcome, conduct, pricing, cancellation, no-show fees, deposits, refunds, or injury — is between you and the Provider. You should raise it directly with the Provider first.
6.2 Limited, voluntary assistance. PeasyBooking may, at its discretion and without obligation, provide booking records, facilitate communication, or take action consistent with these Guest Terms (such as moderating content under Section 7). Any such assistance does not make PeasyBooking a party to the dispute and does not transfer the Provider's responsibilities to PeasyBooking.
6.3 Regulatory and legal recourse. Nothing in these Guest Terms limits your right to pursue a complaint with the Provider's regulatory body or professional college, or any other remedy available to you under applicable law.

7. Reviews and Content
7.1 Genuine, first-hand reviews only. You may submit a review of a Provider only if you booked and received the Service through the Marketplace and the review reflects your own genuine, first-hand experience. Reviews must be honest, accurate, and your own.
7.2 Prohibited content. You must not submit reviews or other content that:
- (a) is false, misleading, fraudulent, or not based on a genuine first-hand experience;
- (b) is offered, solicited, or posted in exchange for payment, discounts, or other incentives, or is otherwise a fake, incentivized, or manipulated review (including reviews you did not write, or reviews of your own or a competitor's business);
- (c) is defamatory, harassing, threatening, hateful, discriminatory, obscene, or invasive of privacy;
- (d) discloses another person's personal, health, or confidential information without consent;
- (e) infringes intellectual-property or other rights; or
- (f) is spam, advertising, off-topic, or unlawful.
7.3 Moderation and removal. PeasyBooking may, but is not obligated to, review, moderate, decline to publish, edit for length or formatting, or remove any review or content that we reasonably believe violates these Guest Terms, our content policies, or applicable law, or that is the subject of a credible complaint. We use reasonable measures to detect and prevent fake or manipulated reviews. We do not remove reviews simply because a Provider disagrees with an honest, genuine review.
7.4 Licence to your content. You retain ownership of the content you submit. You grant PeasyBooking a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, and display your reviews and content as needed to operate the Marketplace and the relevant Provider listing, including syndicating a review for display in connection with that Provider's listing across the Marketplace. This licence is sublicensable only to our hosting providers and subprocessors to the extent necessary to deliver these functions. PeasyBooking will not use your review or content (or any personal information it contains) in marketing or advertising except with consent that complies with applicable privacy and anti-spam law and as described in the PeasyBooking Privacy Policy. This licence continues for content that remains published; it survives termination to the extent necessary to keep already-published content available and to maintain records.
7.5 Your responsibility. You are responsible for the content you submit and represent that you have the right to submit it and that it complies with these Guest Terms.

8. Payments
8.1 Payments are processed by Stripe; the Provider is the merchant of record. Online payment for a Service is available only where the Provider has enabled it by connecting its own Stripe account; otherwise you arrange payment with the Provider directly. Where online payment is enabled, the payment is processed by Stripe (Stripe, Inc. and its affiliates) directly on the Provider's connected account (Stripe direct charges). The Provider is the merchant of record and receives settlement directly from Stripe. PeasyBooking provides only the booking software that directs you to Stripe: PeasyBooking does not receive, hold, take custody of, control, settle, or transmit funds for Services, is not the Provider's agent for collecting funds, and is not the merchant of record.
8.2 No marketplace commission. PeasyBooking currently charges Guests no marketplace commission, booking fee, listing fee, or lead fee for using the Marketplace. If PeasyBooking ever introduces a Guest-facing fee, it will be clearly disclosed to you before it applies, will require your agreement where the law so requires, and will not change the price of an already-confirmed booking. Standard third-party payment-processing fees may apply to the Provider (not to you) in accordance with the Provider's arrangement with Stripe.
8.3 What you authorize. When you pay, you authorize the charge to your selected payment method for the Service price, any applicable taxes set by the Provider, and any deposit, cancellation, no-show, tip, membership, or package amount you agree to, in accordance with the Provider's disclosed terms.
8.4 Taxes. Any taxes (including GST/HST) on a Service are set, charged, collected, and remitted by the Provider. PeasyBooking does not determine or remit taxes on Services.
8.5 Stripe terms and processing. Your card and payment information is collected and processed by Stripe under Stripe's terms and privacy policy. Stripe may process payment data outside Canada. PeasyBooking does not store full payment-card numbers. See the PeasyBooking Privacy Policy for how payment information is handled.

9. Guest Accounts, Profiles, Communications, and Marketing Consent
9.1 Guest accounts. Some features require a Guest account or profile, which may store your contact details, booking history, communications, and preferences. PeasyBooking has its own relationship with you as a Guest and is responsible, as the controlling organization, for your Guest account, your searches, your bookings, your reviews, and your Marketplace communications with PeasyBooking. How we handle this information is described in the PeasyBooking Privacy Policy (see the guest/marketplace section).
9.2 Accuracy and security. You agree to provide accurate information, to keep your account credentials confidential, and to be responsible for activity under your account. Notify us promptly of any unauthorized use.
9.3 Transactional communications. To operate the Marketplace, we and Providers may send you non-marketing transactional messages by email and, where you have provided a mobile number and consented, by SMS — for example, booking confirmations, reminders, changes, cancellations, and receipts. These are part of the service you requested.
9.4 Marketing and commercial electronic messages (CASL). Marketing consent is sought separately and is not a condition of booking or of using the Marketplace. We do not bundle marketing consent into the act of booking. Where you have given the required consent, commercial electronic messages — such as promotions, deals, review requests, re-engagement, membership offers, and referrals — may be sent by email or SMS. Consistent with Canada's Anti-Spam Legislation (CASL):
- (a) PeasyBooking-sent messages. Where PeasyBooking is the sender, PeasyBooking will identify itself as the sender, provide its contact information, and include its own unsubscribe mechanism. PeasyBooking-sent marketing relies on consent you have given to PeasyBooking.
- (b) Provider-sent messages. Where a Provider is the identified sender, the Provider is responsible for the lawful purpose, the consent basis, and the content of its commercial electronic messages, and for identifying itself and providing its own unsubscribe mechanism. PeasyBooking provides delivery tools and suppression controls; each party remains responsible for its own obligations under CASL.
- (c) Withdrawing consent. You may withdraw consent at any time. An unsubscribe request applies to the sender named in the message; we will give effect to unsubscribe requests for PeasyBooking-sent messages promptly as required by law.
Withdrawing marketing consent does not stop transactional messages necessary to complete or manage your bookings. Standard message and data rates may apply to SMS. The allocation of sender roles in this Section is consistent with the PeasyBooking Privacy Policy.
9.5 SMS delivery provider. SMS messages are delivered through our third-party messaging provider Twilio Inc. (United States), which may process limited data (such as your mobile number and message content) outside Canada for the purpose of message delivery. SMS is opt-in, and you can reply STOP at any time to stop receiving texts. See the PeasyBooking Privacy Policy and the PeasyBooking Subprocessor List for current details.
9.6 Where your data is processed. Core account and booking data is hosted in Canada (Google Cloud Platform, Montréal region), and the backups of that data are stored in the United States (Google Cloud us multi-region). Certain third-party providers — including authentication, payments (Stripe), email, and SMS — process limited data outside Canada to deliver their functions. PeasyBooking does not claim that all data stays in Canada. For full details of what is processed where and by whom, see the PeasyBooking Privacy Policy and the PeasyBooking Subprocessor List.

10. Acceptable Use
10.1 You agree not to:
- (a) use the Marketplace for any unlawful, fraudulent, or harmful purpose;
- (b) make bookings you do not intend to honour, or abuse cancellation, refund, or chargeback processes;
- (c) submit false, fake, incentivized, or manipulated reviews (see Section 7);
- (d) impersonate another person or misrepresent your identity or affiliation;
- (e) harass, threaten, defame, or harm any Provider, Guest, or PeasyBooking personnel;
- (f) scrape, harvest, copy, or extract data from the Marketplace except as expressly permitted;
- (g) interfere with, disrupt, probe, or attempt to gain unauthorized access to the Marketplace or its systems, or circumvent security or access controls;
- (h) introduce malware or other harmful code; or
- (i) use the Marketplace to compete with PeasyBooking, to solicit Providers or Guests off-platform in violation of these terms, or to build a competing service.
10.2 We may investigate suspected violations and may suspend or terminate access (see Section 14) and report unlawful conduct to authorities.

11. Rankings and Promoted Listings
11.1 How results are ordered. Search results and Provider rankings on the Marketplace may be influenced by factors such as relevance to your search, location and distance, availability, Service category, Provider responsiveness and standing, review information, and Guest preferences. Rankings are provided for convenience and are not an endorsement, rating, or guarantee of any Provider.
11.2 Promoted and sponsored listings. Some listings may be promoted, sponsored, or featured, meaning a Provider has paid or otherwise arranged for increased visibility. Where a listing is promoted or sponsored, it will be clearly and conspicuously identified as such (for example, labelled "Sponsored", "Promoted", or "Ad"). Promotion affects placement only and does not change a Provider's responsibilities or our disclosures about it.

12. Intellectual Property
12.1 The Marketplace, including its software, design, text, graphics, and trademarks (including "PeasyBooking"), is owned by PeasyBooking or its licensors and is protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use the Marketplace for your personal, non-commercial use in accordance with these Guest Terms. All rights not expressly granted are reserved. Provider names, logos, and content belong to the respective Providers.

13. Disclaimers
13.1 "As is." To the maximum extent permitted by law, the Marketplace and all content and listings are provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
13.2 No warranty as to Providers or Services. PeasyBooking does not warrant or guarantee the quality, safety, legality, licensing, availability, pricing, suitability, or outcome of any Provider or Service, or that any Provider will perform as described or at all. As stated in Section 1.4, PeasyBooking does not verify Provider credentials, insurance, or standing. PeasyBooking does not warrant that listings, availability, reviews, or other content are accurate, complete, or current.
13.3 Availability. We do not warrant that the Marketplace will be uninterrupted, error-free, secure, or free of harmful components, or that defects will be corrected.
13.4 Some jurisdictions do not allow the exclusion of certain warranties; in that case, the exclusions in this Section apply to the fullest extent permitted by applicable law.

14. Suspension and Termination
14.1 You may stop using the Marketplace at any time. You may request closure of your Guest account as described in the PeasyBooking Privacy Policy.
14.2 We may suspend, restrict, or terminate your access to the Marketplace, with or without notice, if we reasonably believe you have violated these Guest Terms, engaged in fraud, abuse, or unlawful conduct, or where necessary to protect Guests, Providers, PeasyBooking, or the public, or to comply with law.
14.3 Survival. Any provision of these Guest Terms that by its nature should survive termination does so, including, without limitation, Sections 1.2–1.4 (platform status and non-verification), 3 (Provider responsibility), 4 (emergency disclaimer), 6 (disputes), 7.2, 7.4, and 7.5 (prohibited content, content licence, and your-content representations), 8 (payments, merchant-of-record allocation, and chargebacks, as applied to bookings made before termination), 12 (intellectual property), 13 (disclaimers), 15 (limitation of liability), 16 (indemnity), and 17 (governing law and general terms). Survival applies to any provision necessary to give effect to rights or obligations that accrued before termination, including with respect to any booking, payment, or review made before termination.

15. Limitation of Liability
15.1 No liability for Providers or Services. To the maximum extent permitted by law, PeasyBooking is not liable for any act, omission, conduct, negligence, breach, injury, loss, or damage caused by or arising from a Provider, a Service, the professional care or judgment of a Provider, a Provider's licensing or insurance status, or any dispute between you and a Provider.
15.2 Exclusion of indirect damages. To the maximum extent permitted by law, PeasyBooking and its affiliates, directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business, arising out of or relating to the Marketplace or these Guest Terms, even if advised of the possibility of such damages.
15.3 Aggregate cap. Subject to Section 15.4, and to the maximum extent permitted by law, PeasyBooking's total aggregate liability to you arising out of or relating to the Marketplace or these Guest Terms — for any and all claims — will not exceed the greater of (a) the total amounts (if any) you paid to PeasyBooking (as opposed to a Provider) for use of the Marketplace in the twelve (12) months before the event giving rise to the claim, and (b) CAD $100. In the event of any conflict between these Guest Terms and any other PeasyBooking document as to a Guest's claims, these Guest Terms govern.
15.4 Carve-outs from the cap and exclusions. The cap in Section 15.3 and the exclusion of indirect damages in Section 15.2 do not apply to, and nothing in these Guest Terms limits or excludes, PeasyBooking's liability for:
- (a) bodily injury or death caused by PeasyBooking's negligence;
- (b) PeasyBooking's breach of its own privacy or data-security obligations;
- (c) fraud or fraudulent misrepresentation by PeasyBooking;
- (d) PeasyBooking's willful misconduct;
- (e) PeasyBooking's gross negligence; and
- (f) any other liability that cannot be limited or excluded under applicable law.
The cap and exclusions in this Section apply only to claims other than those listed in this Section 15.4.
15.5 The limitations in this Section reflect a reasonable allocation of risk and are an essential basis of the bargain between you and PeasyBooking, given that PeasyBooking is a platform and not the provider of any Service. Nothing in this Section affects your statutory rights as a consumer that cannot be waived or limited by agreement, including, for Quebec residents, your rights under the Consumer Protection Act (Quebec) and, elsewhere, your rights under the consumer-protection legislation of your province or territory.

16. Indemnity
16.1 To the extent permitted by law, you agree to indemnify and hold harmless PeasyBooking and its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and reasonable expenses (including reasonable legal fees) arising out of or related to (a) your misuse of the Marketplace, (b) your violation of these Guest Terms or applicable law, (c) content you submit (including reviews), or (d) your dealings or disputes with a Provider. This Section does not apply to the extent a claim arises from PeasyBooking's own gross negligence, willful misconduct, fraud, or breach of its privacy or data-security obligations.

17. Governing Law and General Terms
17.1 Governing law and forum. These Guest Terms and any dispute arising out of or relating to them or the Marketplace are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict-of-laws rules. You and PeasyBooking agree to the non-exclusive jurisdiction of the courts located in Alberta. Nothing in this Section deprives you of, or requires you to give up, any right you may have under the consumer-protection or other mandatory laws of your home province or territory to bring or defend proceedings in the courts of that province or territory, or to have those laws apply, where the law so provides. This choice of law and forum does not override mandatory consumer-protection rights that apply to you.
17.2 Changes to these Guest Terms. We may update these Guest Terms from time to time. Material changes will be notified by reasonable means (such as posting an updated version with a new effective date or notifying you in your account). Your continued use of the Marketplace after changes take effect constitutes acceptance of the updated Guest Terms. If you are a consumer in Quebec, we will send you a written notice of any amendment at least 30 days before it takes effect, setting out the new clause (or the amended clause and the clause as it read formerly) and the date the amendment comes into force, and you may refuse the amendment and rescind — or, because these Guest Terms involve sequential performance, terminate — these Guest Terms without cost, penalty, or cancellation indemnity by sending us a notice to that effect no later than 30 days after the amendment takes effect, as provided by section 11.2 of the Consumer Protection Act (Quebec).
17.3 Privacy. Your use of the Marketplace is also subject to the PeasyBooking Privacy Policy, which describes how PeasyBooking collects, uses, and discloses your information as a Guest, including where data is processed (see Section 9.6). Please review the guest/marketplace section of that policy.
17.4 Entire agreement; severability; no waiver; assignment. These Guest Terms, together with the documents referenced in them, are the entire agreement between you and PeasyBooking regarding the Marketplace. If any provision is found unenforceable, the remaining provisions stay in effect, and the unenforceable provision will be limited or severed to the minimum extent necessary so that the rest of these Guest Terms remain in force. Our failure to enforce a provision is not a waiver. You may not assign these Guest Terms; we may assign them to an affiliate or successor.
17.5 Language. These Guest Terms are provided in English. The English version is the only authoritative version and governs for all purposes; any translation that may be provided is for convenience only. Where the mandatory consumer-protection or language law of your province, territory, or state requires otherwise, that law prevails for you to the extent of the conflict, and any such requirements will be addressed before the Marketplace opens to Guests in that jurisdiction.
